All of the data generated in your IT infrastructure is seriously valuable.
Why? It contains a definitive record of application performance, security
threats, fraudulent activity, and more. Splunk takes this data and makes
sense of it. IT sense. And common sense.

+--------------------------------------------------------------------------------------------------------

Hallowe'en is just around the corner. I've spent hours this month poring
over masks, fog machines, automated monsters, and sound-activated dancing
skeletons (mostly too rich for my blood), and worked with my brother and
sister to haunt my mom's house with scary pictures, mounds of
spider-webbing, sound effects, strobe lights, stage blood, candles, and
rusty knives. Like every year, though, the best laid plans are the ones
you come up with after the fact (why do I always plan to build a coffin
with Bible-repelling magnetic lid and matching Bible, but never do?), and
while our effort was fun and satisfying, it definitely didn't push the
envelope. (There's plenty of good inspiration out there, though, for
people who do want to [0]go [1]a [2]little [3]crazy.) So I ask: What are
you doing to celebrate the spirit of Hallowe'en? In particular, are you
using any good stagecraft-style tech to make your dwelling, yard, or
neighborhood just a little bit scarier than usual? Any good advice based
on previous haunting experiences, either as haunter or hauntee? What
effects do you wish you could create, given enough time and money? Do you
control any aspect of your display by computer? Think broadly: Links to
inspiring commercial haunts, sources of interesting gear, and your
favorite house-haunting projects at Instructables are all welcome, as
well as relevant advice from the parts of the world where Hallowe'en
isn't the major event that it is in the U.S.

IDG reports that "The U.S. Federal Communications Commission has [0]voted
to overhaul a decades-old system of telephone subsidies in rural areas,
with the funding refocused on broadband deployment. The FCC's vote
Thursday would transition the Universal Service Fund's (USF's) high-cost
program, now subsidizing voice service, to a new Connect America Fund
focused on broadband deployment to areas that don't yet have service. The
FCC will cap the broadband fund at $4.5 billion a year, the current
budget of the USF high-cost program, funded by a tax on telephone bills."
That cap, says Reuters, is "the [1]first budget constraint ever imposed
on the program."

mikemuch writes "The standard that eventually became CSS was originally
submitted to Tim Berners-Lee et al by Haakon Wium Lie, who continues to
have new ideas for the web formatting language. The latest proposal from
the current CTO of Opera Software is the CSS Generated Content for Paged
Media Module. [0]Lie sat down with PCMag to discuss not only this
scrollbar-free browsing initiative, but a wider range of Web topics,
including thoughts on powers like Apple and Google. A teaser from the
story: 'At Opera, we sometimes wake up in the morning and see a new
Google service that could have been optimized if we could have worked
with them in the development phase. It seems they're more eager to put
out things and see what sticks.'"

[0]angry tapir writes "The intellectual property lawsuit between Oracle
and Google over the Android mobile OS [1]won't go to trial until next
year, according to a ruling made in the U.S. District Court for the
Northern District of California by the judge overseeing the case. The
trial was initially set to begin Oct. 31 but was postponed last week by
Judge William Alsup due to scheduling conflicts with a major criminal
trial. The trial will be split into three stages heard by the same jury.
In step one, 'liability on the copyright claims, including all defenses
thereto, will be tried and determined by special verdict before going to
Phase Two,' he wrote. The second phase will cover liability on the case's
patent claims, he added. 'The jury will decide these issues before going
to Phase Three.' In the final stage, 'all remaining issues will be tried,
including damages and willfulness.'"

World: "Sony took a page out of the playbooks of Microsoft and Apple,
announcing [0]it would buy out its smartphone partner, Ericsson, to more
tightly integrate smartphones with Sony's laptops, tablets and
televisions. The move gives Sony complete control over its smartphone
business, while Ericsson will now focus more broadly on wireless
connectivity for products beyond mobile handsets. Sony purchased
Ericsson's share of the Sony Ericsson partnership for about $1.47
billion. Rumors about Sony's takeover of Sony Ericsson surfaced in early
October."

| Copyright Troll Righthaven Ordered To Pay $119,000

+--------------------------------------------------------------------------------------------------------

[0]Hugh Pickens writes writes "Steve Green reports that newspaper
copyright infringement lawsuit filer Righthaven of Las Vegas has been hit
with [1]an order to pay $119,488 in attorney's fees and costs in its
failed lawsuit against former federal prosecutor Thomas DiBiase, who was
sued over allegations he posted a story without authorization on a murder
case by the Las Vegas Review-Journal. US District Judge Roger Hunt
dismissed Righthaven's suit against DiBiase this summer because
Righthaven lacked standing to sue him under its flawed lawsuit contract
with R-J owner Stephens Media. The DiBiase case was noteworthy because
his attorneys at the EFF said DiBiase's nonprofit website, 'No Body
Murder Cases,' [2]performed a public service by assisting law enforcement
officials in bringing justice to crime victims and that his post was
protected by the fair use concept of copyright law. Case law created by
the Righthaven lawsuits suggests DiBiase's use of the story would be
protected by fair use as it was noncommercial and judges have found there
can be no market harm to Righthaven for such uses since there is no
market for copyrights Righthaven obtains for lawsuit purposes. Although
this was by far the largest fee award against Righthaven, it will likely
will be dwarfed by an upcoming award in [3]Righthaven's failed suit
against the Democratic Underground."
